Managing Expectations in Arbitration
Ziya Akıncı Yasin EkmenArbitration has become an increasingly common method of dispute resolution The primary reason for this is that arbitration can resolve disputes faster and more efficiently than other dispute resolution methods To make arbitration more successful it is necessary to examine the expectations on arbitration This study examines these expectations from different perspectives The parties arbitrators counsel and the arbitral institutions all play important roles in arbitration proceedings Therefore it is useful to consider the issue from the perspectives of these actors and institutions involved in the arbitration to determine their expectations Furthermore for arbitration to be successful it is important that the courts are arbitration friendly This study analyzes all these expectations and provides recommendations for arbitration practice ÖNSÖZDEN Uyuşmazlıkların çözümünde tahkim gittikçe daha çok yaygınlaşan bir yöntem olmuştur Bunun en önemli nedeni tahkim yönteminde diğer çözüm yollarından daha hızlı ve etkin olarak uyuşmazlıkların çözülebilmesidir Tahkim yolunun daha başarılı olması için tahkimle ilgili beklentilerin incelenmesi gerekmektedir Bu çalışma tahkimle ilgili beklentileri farklı açılardan ele almaktadır Tahkim yargılamasında taraflar hakemler taraf vekilleri ve tahkim kurumu önemli rol oynamaktadır Bu nedenle konuya tahkime dahil olan bu kişi ve kurumların gözünden bakmak söz konusu ilgililerin beklentilerini belirlemek açısından yararlı olacaktır Bundan başka tahkimin başarılı olması için mahkemelerin tahkim dostu olmasının önemi büyüktür İşte bu çalışma tüm bu beklentileri inceleyerek tahkim uygulaması açısından öneriler getirmektedir ÖNSÖZDEN
